1. Acceptance of Terms

Welcome to TopoXY! These Terms of Service govern your access to and use of the TopoXY mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device for personal and professional purposes.

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose

3. App Functionality

TopoXY is a coordinate conversion and terrain analysis application that:

• Converts coordinates between Stereo70 (Romanian projection) and WGS84 (GPS)
• Provides elevation data and terrain analysis
• Generates elevation profiles between two points
• Displays ANCPI ortophoto satellite imagery for Romania

IMPORTANT: Coordinate conversions and elevation data are provided for informational purposes. For official surveying or legal purposes, always verify results with certified professionals.

4. Subscriptions and Payments

• Subscriptions are billed through your Apple ID account in your local currency, VAT included where applicable
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Manage subscriptions in Settings → Apple ID → Subscriptions

4.1 Right of Withdrawal Waiver (EU Consumers)

By tapping "Continue" or "Subscribe", you expressly request immediate access to TopoXY's digital content and acknowledge that you waive your statutory 14-day right of withdrawal under Article 16(m) of Directive 2011/83/EU. This is implemented in RO OUG 34/2014 art.16 lit. m, DE BGB §356(5), IT Codice del Consumo art.59 lett. o, PL Ustawa o prawach konsumenta art.38, CZ §1837 OZ, SK §7 ods.6 zákona č. 102/2014. Your statutory rights under mandatory consumer law remain unaffected.

4.2 Refunds

Refunds are processed exclusively by Apple under Apple Media Services Terms. Request a refund at reportaproblem.apple.com. We do not issue refunds directly. The foregoing does not affect mandatory consumer protection rights granted by your country of residence.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that coordinate conversions are suitable for official surveying purposes.

6. Limitation of Liability

TopoXY shall not be liable for any damages resulting from reliance on coordinate conversions or elevation data, errors in terrain analysis, or unavailability of third-party data sources.

7. Privacy

Your use of the App is also governed by our Privacy Policy.

8. Third-Party Services

TopoXY integrates with Mapbox, ANCPI, Google AdMob, Firebase Analytics, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania. For EU consumers, the mandatory consumer protection rules of your country of habitual residence apply where more favourable. For consumer disputes, the courts of your country of habitual residence have jurisdiction in accordance with Articles 17–18 of Regulation (EU) 1215/2012 (Brussels I Recast). For non-consumer disputes, the competent courts of Bucharest, Romania shall have exclusive jurisdiction.
